Responsibility
African Portfolio Inc. is in all respects the agent of the client. African Portfolio Inc. books transportation, accommodation, adventure activities and other services from various foreign, independent ground operators/suppliers, who are not subject to the control of African Portfolio Inc. Client travel arrangements are accepted by African Portfolio Inc. as agent for these independent operators. Services provided by these operators/suppliers are offered subject to the terms and conditions contained in the tickets, itineraries or booking confirmations issued by them. Although African Portfolio Inc. has made every attempt to retain the services of experienced, competent, and trustworthy ground operators it CANNOT BE LIABLE FOR ANY PERSONAL INJURY, FINANCIAL DEFAULT OR PROPERTY DAMAGE which may occur due to: 1) wrongful, negligent or arbitrary acts or omissions on the part of a supplier, its employees and others not under the direct control of African Portfolio Inc.; or 2) defects or failure of any aircraft, vessel, vehicle or other equipment or closure of property or inability to provide services instrumentally under control of independent suppliers; or 3) acts of god, including but not limited to natural disasters or public health pandemics.
Land, Sea and Air Transportation
Carriage by land, sea and air is subject to the terms and conditions of the carrier and to international conventions, which may limit liability. Land, sea and air travel are also subject to financial and operational decisions of carrier and air/seaports which may result in cancellations, delays or diversions over which African Portfolio Inc. has no control and for which African Portfolio Inc. accepts no liability whatsoever. Loss of baggage is the responsibility of the carrier and the client.
Liability
a) African Portfolio Inc. cannot be held responsible if the internal infrastructure of a country causes adverse effects, which prevent the ground operator from delivering the usual standard of service, including but not limited to, the hazards of traveling in politically unstable areas and arbitrary changes or other restrictions mandated by government or private authorities. Safaris by their nature, are adventure holidays and as such, changes in the details and timing of an itinerary can vary from time to time, depending on conditions prevailing and facilities available. b) Any and all disputes concerning this contract, collateral material, web site, or the trip shall be resolved solely and exclusively by binding arbitration and according to the substantive law of Connecticut and the then current rules of the American Arbitration Association in CT.
Booking Procedures and Payment Terms
African Portfolio Inc. requires completion of our online reservation process, acceptance of these Terms and Conditions and a $500 per person non-refundable reservation fee to make a provisional reservation. African Portfolio Inc. will confirm a provisional reservation upon receipt of a further non-refundable deposit of 30% of the tour price. (Note: Travel during peak holiday periods, with certain safari operators or for groups of 10 or more travelers may be subject to additional deposit or early payment requirements). The reservation fee and deposit are fully non-refundable but applicable to the tour price. Foreign currency-based supplier rates can fluctuate relative to the US dollar and may result in a price increase at final invoice. Any airfare quotes are estimates only and are subject to change until tickets are issued. Unless otherwise specified, ticketed flights are non-refundable. Amendments to flights are subject to applicable change fees and any increase in fare. Deposit and final payments are payable by check or wire transfer only. The balance of payment is due ninety (90) days prior to departure date. Failure to remit payment by the stated due date will be deemed a fundamental breach of this contract and African Portfolio Inc. will cease to have liability to its client to deliver said services. Reservations made within ninety (90) days of departure are subject to full payment upon confirmation. The client is fully liable to African Portfolio Inc. for any deposit requirements, cancellation penalties and contractual obligations the company has undertaken on behalf of the client with all service providers including ground operators, suppliers or airlines.
Insurance
African Portfolio Inc. includes emergency medical services and/or evacuation transportation coverage (unless otherwise noted). African Portfolio Inc. strongly recommends the purchase of trip cancellation coverage to protect your investment in the event of an unforeseen cancellation for insurable reasons, e.g. medical. Details are provided on request. Clients residing outside of the United States are not covered and must purchase independent travel insurance and provide proof of coverage.
Refunds and Change Fees
No refunds will be issued for any unused accommodation, tours, activities, meals or services, including the cancellation of domestic and regional air tickets. A $250 per person service fee will be charged for any requested changes to air or land arrangements within 90 days of departure or once a final invoice is issued.
Cancellations
a) African Portfolio Inc. will not cancel the travel arrangements once full payment is received unless it becomes necessary due to hostilities, war or threat of war, civil strife, industrial dispute, terrorist unrest, active or threatened, natural or nuclear disaster, public health threats, pandemic, fire or adverse weather conditions, or if a group tour does not have the minimum required participants, or for any other adverse event beyond the control of African Portfolio Inc. In the event of a cancellation, African Portfolio Inc. will inform the client without delay and will make every effort to offer a suitable and comparable alternative.
b) If a client chooses to cancel their trip, applicable cancellation fees are: More than 120 days prior to departure: Full Deposit; 120 – 106 days: 50% of tour price; 105 days – departure date: 100% of tour price. In addition, clients are subject to any and all cancellation fees imposed on African Portfolio Inc. by suppliers and airlines. All cancellations must be in writing, signed by the client, received and acknowledged by African Portfolio Inc.
Your Personal Information
African Portfolio Inc collects personal information about our clients including but not limited to: Full name, email, address, passport details, nationality, dietary restrictions, physical limitations, wedding anniversary, birthdate, and other personal information. This information is necessary to provide you with a customized travel service. This information is securely stored will never be sold to third parties.
Removal of Personal Information
After you return from your trip, if you would like African Portfolio Inc to delete your personal data, you can send a request in writing to [email protected] with a subject line “Delete My Data” and African Portfolio will immediately delete all personal data collected about you. If you do not request removal of your personal information, African Portfolio Inc will continue to store your personal information for your next trip with African Portfolio Inc.
Requesting A Copy of Your Personal Information
If you would like to receive a copy of your personal information stored by African Portfolio Inc, please send a request in writing to [email protected] with a subject line “Request A Copy Of My Data” and African Portfolio Inc will immediately provide you with a copy of your personal data.
